I'm glad you're checking out my Terms of Service. I run a one-woman show here, so it’s just you and me. By using my website or services, you’re agreeing to these rules, which helps keep everything clear and straightforward for both of us.
Use of Website and Services
Respect The Grind
You agree to use my website and services lawfully and respectfully. Any attempt to misuse, manipulate, or interfere with the site, my business operations, or other users is prohibited.
I made this... it's mine...
All content on my website including, but not limited to, designs, graphics, photos, videos, text, templates, concepts and digital products, are owned by Misschif Media unless otherwise stated. You may share my work, but I ask that you still give credit where it is due.
Services I Offer
Customized Work - One Size Does Not Fit All
All services including photography, videography, branding, design, strategy, and social media management, are custom built for each client. Deliverables are created specifically for your project and usage rights are limited to what we explicitly agree on. I don't believe in the concept of not having a brand fits YOU, because after all it is your brand.
AI Is Not For Me
While I love some of the ways AI can be used, I will not copy exactly what your AI project is. It's good to use it for inso and get the idea, but I am a real person with real creativity, so I have the right to turn down a project. So please don't ask, "but why can't you just do exactly how AI does it?" ALSO you are not allowed to change my work with AI.
Editing My Work
Editing any of my photos, videos, graphics, etc are NOT allowed. I spend countless hours to create and build my work.
Payments and Refunds
Retainers & Billing
A 25-50% non-refundable retained is required to secure your booking or project date. Work doesn't begin and your date is not locked in until the retainer is received. Remaining payments must be made day of due date that is provided to you in a text, email, invoice or contract.
Late Payment
Late payments may result in delayed delivery and/or late fees. Continued non-payment may result in termination of services.
Refunds
All retainers and payments are non-refundable, as they cover time already reserved, work already completed and resources allocated to your project. Refunds are ONLY issued if I, Misschif Media, am unable to complete the agree upon service due to circumstance on my end. This does not include not being able to complete the work due to you, as the client, not providing me the information, media and other things needed to complete said project.
Turnaround, Revisions & Deliverables
Delivery Timeline
Estimated timelines will be provided, but they are subject to reasonable changes due to workload, technical issues or unforeseen circumstances. I'll always communicate if something shifts. Timeline also depends on the timely manner you give any material need to complete the project (if applicable).
Revisions
Revisions are included only as specified in your proposal or project agreement. Additional edits outside that scope may incur extra fees. If you don't respond within 72 hours when requesting for revisions, your project will be pushed to the bottom of the list.
Not Responsible for the Unexpected
I am not liable for delays or losses caused by factors outside of my control, including, but not limited to: technology failures, data loss, website outages, client delays, acts of nature, third-party platforms malfunctioning.
Limitation of Liability
While I do my absolute best to deliver high-quality creative work, results can vary. I cannot guarantee specific outcomes regarding engagement, sales, analytics, or platform performance.
No Guarantees
Maximum Liability
To the fullest extent permitted by law, my liability is limited to the total amount paid for the specific service in question..
Cancellations & Rescheduling
Client Cancellations
If you cancel your project, your retainer is forfeited and may not be transferred to another project unless mutually agreed on.
Rescheduling
Rescheduling may be permitted depending on availability, but new dates are not guaranteed. Additional fees may apply for last-minute changes.
As my business evolves, I might need to update these terms. Any changes will be posted here and are effective immediately.
